Growalty Terms of Service
1. Acceptance of Terms
By accessing or using the mobile application and/or website of Growalty (the "Platform"), you accept these Terms of Use, our Privacy Policy and the Acceptable Use, which form an integral part of these Terms. If you do not agree, do not use the Platform.
2. Description of Service
Growalty is a loyalty program platform designed to connect businesses with their customers through digital rewards, integrating features with Apple Wallet and Google Wallet. Each business can create an account and operate from the Growalty app. Depending on the configuration, different user roles may exist (e.g., owner and employee), with differentiated permissions. Use requires secure authentication via Google or Apple. Content exchange between users outside the provided functionalities is not permitted.
3. Eligibility Requirements
You must be at least 13 years old (or the legal age in your jurisdiction) to use the Platform. By using it, you warrant that you meet this requirement and have the legal capacity to accept these Terms.
4. User Accounts
Access is through passwordless authentication via Google or Apple. You are responsible for the accuracy of your data and for maintaining the confidentiality and security of your session. You are also responsible for any activity that occurs with your credentials.
5. Acceptable Conduct
You agree to comply with the Acceptable Use, which details prohibited uses, such as fraud, abuse, spam, reverse engineering, malware distribution, violation of third-party rights, or any illegal activity. Non-compliance may result in suspension or cancellation of your account.
5.1 Export and Use of Personal Data
The Owner and/or authorized Administrators may access, view, and export personal data of users associated with their account only when:
- •such actions are necessary for the provision of the service; or
- •the user has granted express consent to receive commercial communications, participate in promotional actions, or be included in marketing strategies.
The Owner shall be responsible for the proper, secure, and lawful use of any exported file containing personal data, including its storage, encryption, internal access, and deletion once the purpose has been fulfilled.
6. License and Permitted Use
You are granted a limited, non-exclusive, revocable, and non-transferable license to use the Platform for personal and/or commercial purposes, in accordance with these Terms and the Acceptable Use Policy.
7. Intellectual Property
All rights to the brand, software, designs, and content belong to Growalty or its licensors. Copying, modifying, creating derivative works, or redistributing any component without express written authorization is not permitted.
8. Third-Party Services
The Platform may integrate third-party services (such as Google, Apple, or others). You also accept the terms and conditions of those external services. Growalty is not responsible for the content or operation of such services.
9. Payments and Subscriptions
Monthly or annual subscriptions are managed exclusively through Google Play and App Store. Cancellations and modifications must be made through those platforms. Growalty does not process payments directly.
10. Voluntary Cancellation and Termination
You may request cancellation of your account at any time by writing to info(at)growalty.com. Growalty may suspend or cancel your access at any time for violations of these Terms, the Acceptable Use Policy, or by legal requirement.
11. Disclaimer of Warranties
The service is provided "as is" and "as available," without warranties of continuous operation, availability, accuracy, or fitness for a particular purpose.
12. Limitation of Liability
To the maximum extent permitted by law, Growalty shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the Platform.
13. Indemnification
You agree to indemnify and hold harmless Growalty against any claim, damage, loss, liability, cost, or expense (including reasonable legal fees) arising from your misuse of the Platform or breach of these Terms or the Acceptable Use Policy.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Delaware, United States, and any dispute shall be resolved in the courts of that State.
15. Electronic Communications
By using the Platform, you agree to receive electronic communications, including emails, in-app notifications, and website notices.
16. Modifications
We may update these Terms at any time. If we make significant changes, we will notify you through our official channels. Continued use of the service after the effective date of changes implies acceptance thereof.
